I recently joined a panel of experts in discussing how a proposed “Reverse CFIUS” Executive Order expected soon from the White House will impact venture capital and private equity investments — especially those involving investment targets in China and other global competitors. The panel was moderated by 4thly Accelerator’s Bret Waters, and included my Foley & Lardner Washington, D.C. based national security partner Christopher Swift, US-China expert Ker Gibbs (former chair of AmCham Shanghai and author of upcoming book about doing business in China), and former Defense Department staffer and Crumpton Global partner H.K. Park.

We talked about:

  1. what is “Reverse CFIUS,”
  2. how it will change existing and new investment from the west into China (and Russia),
  3. why it will be regulation instead of legislation,
  4. how to get ready, and
  5. the cost of doing nothing.
